No, regardless of memory, biologically Data is not a human, and their for does not have the cerebrum, a major part of our brain that really is the essence of who we are.

Patrick,
I think you’re prematurely bandying about the term, “human” and associating it with a feature of biology hastily.
Could it not be the case that one could have all the biological parts associated with homo sapiens and not be human?
Could it not be the case that exhibiting certain behaviours qualifies one as human irrespective of tissues contained in a human’s body?
